Third party, precedent based common law contracting has been used for many years however it’s not well known. Furthermore compliant contractor engagement is a legal issue and accounting advice should not necessarily be relied upon.

An ABN is not a business license. Having an ABN does not mean you are automatically running your own business.

The engagement is with a natural person and not an entity – no ABN is needed, just a TFN.

If the relationship is not compliant then a written agreement does not override the law and remove the potential tax and super obligations. In the event of an ATO audit, perhaps generated via a contractor complaint, you may well have Super and Tax liabilities to contend with.

Depending on the role, it may be feasible to redeploy casuals under the managed contractor framework.
It would depend on whether you are actually running a business. For example if you have multiple clients, have employees and you quote for work. NOTE: This is not a definitive answer as there are other indicators to consider.

You should ignore industry practice when determining if a worker is an employee or a contractor. Just because other businesses treat workers as contractors doesn’t mean it is lawful.
